Rush Co IN Will Records vol 6 p138

I, Martin Rigsbee, make this my last will, and hereby revoke all former wills made by me.

Item (1) -- There shall first be paid out of my estate, after my death, all my just
debts, the expenses of my last sickness and burial and of settling of my estate.

Item (2) -- After paying the items provided for in item one of this will, there shall
be paid to my wife, Adeline Rigsbee, in case she survives me, the sum of Two Thousand
Dollars, if there remains that much property belonging to my estate, and if there is not
so much, she shall have all there is. Said sum shall be paid her in money, or if she so
elects, in money and other personal property taken at its appraised value by her. And
I give and bequeath to her the property herein in this item named and she is to have
the same absolutely.

Item (3) -- All my property remaining after complying with items one and two of this will,
I give and bequeath to my son John L Rigsbee, and in case my said wife shall die before
I do, then all my property remaining after complying with item one of this will I give
and bequeath to my said son and he is to have the same absolutely.

Item (4) -- I appoint my said son executor of this will.

In witness whereof I hereunto set my hand and seal this the 18th day of July, 1907.
