Devon Probate Records 1812-1857

This is the last Will and Testament of me John Rigsby of
Monkleigh in the County of Devon Innkeeper I give and bequeath unto
and to the use of my son John Rigsby his Heirs and assigns all that
my freehold Messuage Tenement and farm called Franks close and lays situate
lying and being in the Parish of Shebbear in the said County now in the
occupation of George Paige subject nevertheless to the payment of all the
Principal money and Interest due thereon at the time of my decease , in
Exoneration of my other property. I give and bequeath unto my Children
John Rigsby, Thomas Rigsby, Rebecca Jerred, Isaac Rigsby, Lewis Rigsby
the sum of Five pounds each to be paid to them by my Executors hereafter
named within twelve months after my decease. I also give unto my said
Son Isaac Rigsby a Bed and bedding complete. I give and bequeath
unto my wife Margaret Rigsby my silver spoons the bed and bedding
complete on which I now lay and all monies which my become due at
my decease from Friendly Socities. All the rest residue and remainder of my
goods Chattels and effects and all and singular my Leasehold premises
of what nature and description soever and wheresoever the same may
be situate after payment of my just Debts (except the Mortgage debt
and Interest) on my said Freehold premises Legacies funeral and
Testamentary Expences I do hereby give and bequeath unto my Friends
Robert Taylor of Biddeford Builder and William Partridge of Landcross Yeoman
their Executors administrators and assigns upon trust as to one moiety or
half part thereof for the use of my son William Rigsby his Executors administrator
and assigns absolutely, and as to the other Moiety or half part thereof for the use
of my Daughter Margaret Rigsby her Executors administrators and assigns
absolutely they allowing my said wife to reside with them during her life
or Widowhood. and I appoint the said Robert Taylor and William Partridge
Executors in trust of my said Will and revoke all former Wills made by me
and I do give and grant unto my said Trustees and Executors all
lawful and necessary powers privileges protections and Indemnities for
enabling them and him to carry this my Will into complete effect In Witness
whereof I have hereunto subscribed my name on the twenty second day of July
one thousand eight hundred and fifty six

Signed by the said John Rigsby the Testator and by him acknowledged to be his last Will and
Testament in the presence of us who at his request in his presence and in the presence of each other
have subscribed our names as Witnesses thereto we and the Testator being all present at the same time
