I Cornelius Eltinge of Frederick County, farmer,
being in good health of body and of sound and perfect mind and memory...
do make and ordain this my last Will and Testament...
Item first I do hereby give devise and
bequeath to my loving wife Rebecca Eltinge my now Dwelling house and
plantation thereunto belonging consisting of the following tracts or parcells of land called
Millbrun, my Half of another tract of land called Long Acre, one other tract of land
called Addition, another tract of land called Eltinge's Rest, and one other tract of
land called Derby Island, all situate lying and being in Frederick County aforesaid.
Except such parts thereof as I shall hereinafter otherwise dispose of for and during the
term of her natural life without impeachment of or for any manner of waste under
___ of her Dower and right of Dower to my Reale Estate that power and
___ and to every Part thereof
Item I do also hereby give and bequeath
unto my said loving wife Rebecca Eltinge for and during the course of her natural
life one slave to have the choice of all I have and I also leave her all my stockhold
furniture horses cows sheep hoggs and all their ___ ____ with _______
____ ___ and also all my tools and implements of Husbandry as plows harrows
carts waggons scythes sicles hoes spades ___ gribling [?] ___ axes ___ and all
other tools and implements of the like whatsoever relating to the ___
(Except some of the ___ as I shall hereinafter dispose of.) Each shall by me
be ___ maintained or used with or in ___ or shall be left upon my aforesaid
Plantation _____ _____ as above described in full satisfaction and bar to me
and my right ___ ___ or may ___ a third part of my personal estate or
any ___ ___ thereof
Item I do hereby give and bequeath unto my son Isaac
Eltinge from and immediately after my decease my stile ___ and smith shop
together with all the things belonging to ___ and all implements of what nature
and kind soever therewith and also his choice of two Negro slaves after his mother has
made her choice of one and I also give him two wagons and four horses and two
young horses or mares and three cows fit to give milk and two plows and plowshares
and all the sackling [?] belonging to the waggons and the plows. Also I give him my still
and all of its engine tools and implements of what nature and kind soever
therewith or ___ of them used belonging or in any wise apportaining to him his
heirs and assigns forever.
Item it is my will and desire that from and immediately
after the decease of my said wife or in case she shall within fforty days after the Probate
of this my will remarrie is hereby __ and devised and bequeathed to ____ ____
and ___ of her Dower and ___ and then and or either of the said contingencies
which shall first happen.Said son Isaac have and __ hereby in said case
give and bequeath unto him all my tools and implements of Husbandry as ploughs
[repeat above paragraph]
Item it is my will and desire thus
after payment of my debts and funeral charges the residue and remainder of my
personal estate not herein before disposed of be equally [inserted: divided] among all my children without any
regard had in such decision to any thing which I have herein or att any time heretofore
given them or any of them and in like manner such parts of my personal estate therefore
whereof I have herintofore given and bequeathed to my wife during her life and which I
have not further herein disposed of to and shall immediately from and after her decease
my debts and funeral charges being paid and satisfyed be equally divided among all
my children without any regard had in such division to any thing which I have herein
at any time heretofore given them or any of them.
Item Whereas I have by separate
deeds already executed given and granted to my daughters severally or to their
several husbands or to them severally and their respective husbands estates in several
tracts or parcells of my land and real estate I do hereby establish and confirm the said
several deeds and estates therein given or granted or intended to be thereby given and granted
to Sarah Parsons and in such manner as therein respectively mentioned and described according
to the true and Intent and meaning of the said several deeds respectively.
Item I do ordain and appoint my said son Isaac Eltinge and my son in law John Hite and my son in
law Isaac Hite executors of this my last will and testament.
In witness thereof I have hereunto set my hand and seal this 26th day of April 1751.
