Chapter XXV
Miscellaneous Letters -- Wills -- Indentures -- Commisions

This indenture made the 25th day of April in the year
One Thousand seven hundred and thirty-eight,
between Just Hite, Gent of the County of Orange of the one part
and James Wood, Gent of the County of Orange aforesaid of the
other part. Witnesseth, that the said Just Hite for and in Considera-
tion of the sum of five Shillings Sterling to him in hand paid by the
said James Wood The Receipt whereof is hereby acknowledged hath
granted Bargained, sold ___ unto the said James Wood all that
tract or parcell of Land situate, lying and being in Orange County
Containing by Estimation One hundred Acres of Land be the same
more or less and bounded as followeth viz: Beginning at a stake on
the west side of Opeckon Run &c ___ to have and to
hold every part & Parcell Thereof with the Appurtenances unto the
said James Wood, &c ____ from the day of the date hereof for
and during and unto the full end & term of one whole year from
thence next Ensuing & fully to be Compleated & Ended yielding
& paying therefor one pepper corn in & upon the feast of St
Michael the Archangel &c ____

In witness whereof the said Just Hite hath hereunto set his
hand & seal, the day month & Year first above written.

At a Court held for Orange County on Thursday ye 27th day of
April 1738. Just Hite Gent Acknowledged this his lease of Land
indented to James Wood Gent which on the Motion of the said Wood
is admitted to record.

This indenture made the XXVIth day of April in the Year
one thousand seven hundred & thirty-eight
between Just Hite Gent of the County of Orange of the one
part And James Wood Gent of the County of Orange of the
other part Witnesseth that the said Just Hite for & in Considera-
tion of the sum of Ten Pounds Curr Money to him in hand paid by
the said James Wood The Receipt whereof the said Just Hite doth
hereby acknowledge, Hath granted, &c unto the said James Wood:
in his Actual Possession now being by virtue of a Bargain & sale
to him therof made for one year by Indenture bearing date the Day
next before the date of these Presents and force of the Statute for
Transferring Uses into Possessions: & to his heirs and assigns forever
All that Tract or Parcell of Land Situate lying & being in Orange
County Containing by estimation one hundred Acres of Land be the
same more or less and Bounded as followteh viz &c, It being part
of a Tract of Land containing five Thousand & Eighteen Acres granted
to the said Just Hite by Patent bearing date the third day of October
one thousand Seven hundred Thirty and Four and all houses Gardens
Orchards Meadows Comons Woods trees Ways Waters Profits Como-
dities Hereditaments & Appurtenances whatsoever to the same Be-
longing or in any wise Appertaining, &c to have and to hold
the said Lands Premises & all & Singular & every Part & Parcell
therof with the appurtenances unto the said James Wood his heirs
& assigns to the only proper Use and behoof of the said James
Wood &c ___ And the said Just Hite, &c doth Covenant &
grant to & with the said James Wood &c ___ That he the
said Just Hite now is the true lawfull owner of the said Premises
above mentioned & is Lawfully Seized &c. The Quit rents to become
due for the Premises from the time of this sale only Excepted and
Lastly that he the said Just Hite & his heirs the said Premises with
the Appurtenances to the said James Wood his heirs & Assigns
against himself the said Just Hite his heirs & Assigns & all &
every person or persons Whatsovever claiming any thing in the
above mentioned Premises shall & will Warrant & forever defend

In witness whereof the said Just Hite hath hereunto Set his hand
& Seal the Day month & Year first above Written.

His will (written 1758-04-25) lists sons John, Jacob, Isaac, Abraham, and Joseph (deceased), but not his daughters. Joseph's heirs, who were to receive his part, were listed as John, William, and Ann. His property was appraised in 1761.

A pre-nuptial agreement between Jost Hite and Mary Magdalena Neuschwanger (Nisswanger) was signed in 1741.
