I Jacob Hahn of Carroll County in the State of Maryland being
of good health and of sound disposing mind memory and understanding do make
and publish this my last will and testament in manner and form following to wit
I will and devise all of my estate, real and personal unto my son Samuel Hahn, to him
my said son Samuel Hahn and his heirs forever upon the following trusts, and to and
for the following purposes, to wit:
First in trust to give my wife Mary of my goods and chattels as follows two beds
and bedsteads her choice one bureau, the large ten plate stove standing in my
dwelling room and pipe thereto belonging one Table, Four chairs two iron pots one
frying pan, one Copper tea kettle one Iron Kettle, the corner Cupboard and all
the queen's ware or white earthen cups and saucers, plates bowls coffeepots tea pots and
cream jugs, all the Knives and forks one turning churn two tubs, one cow her choice
two Hogs fifteen bushels wheat, fifteen Bushels corn five Bushels Rye and five
bushels potatoes, & to allow & permit my said wife Mary to have and to hold possess &
enjoy the aforesaid goods & chattels for & during her life time if she shall so long remain and continue
my widow, otherwise during her widowhood only.
Secondly in trust as soon as Conveniently may be after my death to sell and dispose
of the residue of my goods and chattels at public sale, and to collect all Monies due
and owing or to become due to me, and to apply the proceeds of such sales and collec
tions to the payment of my debts, the expences of my funeral and if necessary to the
purchase of any article or articles herein before directed to be given to my wife Mary
and if the proceeds of such sales and collections be more than sufficient for the pur-
poses aforesaid then and in such case to divide such surplus money amongst my
children and grand children hereinafter named, as other Moneys arising from the
sales of my Estate are herein after directed to be divided.
Thirdly, in trust that my said son Samuel Hahn and his heirs for and during the
life time of my said Wife Mary, if she shall so long remain & continue to be my
widow or otherwise for & during her widowhood only shall from year to year or for longer
terms as may be deemed Most expedient leas, rent and to farm let all my said real es-
tate for Money or on shares as shall be judged to be expedient and to pay or deliver to my
said wife Mary during the term aforesaid in each and every year during said term the
one sixth share of the rent or produce of my said real estate Until all my debts are
satisfied, and from and after the satisfaction of my debts aforesaid to pay or deliver
to my said wife annually during the term above specified the one third part of the
rent or the one third share of the produce (except hay of which she is to receive but one
sixth share only) of my said real estate, all kinds of grain to be delivered to her cleaned
by the bushel and hay cured and made by the load, also to fit up and finish the front room
in the lower and second stories on the north side or end of the dwelling house stan
ding on my said real estate for the accommodation of my said wife Mary, and to allow
my said wife during her lifetime if she shall so long remain my widow otherwise
during her widowhood only to have hold and occupy the said two rooms in said dwelling
house and also for and during the term aforesaid to allow her my said wife the use and
privilege of the Kitchen Cellar spring spring house bake oven and such part of the garden
as she may need not exceeding one fourth part of the Whole, also room in a stable for her
Cow and room in a step or pen for her hogs room in a stable or shed to preserve her hay
and pasturage on my said real estate for her cow and hogs to graze and run with the
like animals of tenants occupying my said real estate, also to allow and permit my
said wife Mary to have as much straw as she may have occasion for to use as litter
for her cattle and hogs, and whenever there be fruit in the orchard on the said premises to
allow her so much thereof as she may want for her own use, and at all times during
the term herein before specified, to furnish my said wife Mary with sufficient quan
tity of fire wood for her own use and Consumption from off my said real estate, the said
wood to be cut for my said wife and delivered at her door, and allow and permit
my said wife during the term aforesaid to have free ingress egress and regress to enjoy all
and singular the privileges herein reserved for her comfort and convenience on my said
real estate. The several provision in this my last will and testament contained for the
comfortable living maintenance and support of my said wife Mary to be in lieu & in full
satisfaction of her right of dower and claim to thirds of in and to all my estate real
and personal.
Fourthly in trust In case that my personal estate be insufficient to
pay all my debts, the expences of my funeral and if necessary to the purchase of any ar-
ticle or articles for my wife as aforesaid then and in that case to apply the income
of my said real estate over and above what may be necessary for the purposes herein
before mentioned, to the payment of my said debts, funeral expences, and expences incur-
red in the purchase of any article or articles for my wife as aforesaid and for finishing
and fitting up the two rooms in my dwelling house for the accomodation of my wife
as herein before mentioned and directed.
Fifthly in further trust that my said son
Samuel Hahn or his heirs do & shall as soon as conveniently may be after the
marriage or after the death of my said Wife Mary sell all my said real estate either
in whole or in parts, at public or private sale, and Convey the same to purchasers
and likewise sell and dispose of at public sale the goods and chattels herein before
directed to be given to my wife Mary or such part of the same as may then be remain
ing; and to divide the Money arising from such sales, or such part thereof as may be
left after payment of all my debts (if any of my debts be then remaining unpaid) into
nine equal shares and to pay over the same as follows viz:
One equal share to my
six grandchildren Joseph Hahn Jacob Hahn Liza Hahn Sally Hahn Mar-
garet Hahn and Abraham Hahn children of my son Jacob Hahn deceased,
One equal share to my son Samuel
one equal share to my son Abraham
one equal share to my daughter Elizabeth
one equal share to my daughter Sally
one equal share to my three grand children Mary Ann Mearing Jacob Mearing
Lidia Mearing children of my daughter Rachel deceased to be equally divided
amongst them shares alike;
one equal share to Eliza Hahn and Rachel Hahn
my grandchilren of my daughter Polly deceased to be divided amongst
them shares alike
one equal share to my son Samuel Hahn and his heirs for the
use and benefit of my daughter Catherine including in said share the amount of
principal and interest owing to me on two notes from Isaac Hahn the husband
to my said daughter Catherine In trust that he my said son Samuel or his heirs do
put and place out the said share of Money in some fund or stock or otherwise upon good
and sufficient security, and to pay over the interest or profits accruing or arising on
said share of Money annually or semiannually as may be most suitable to my said
daughter Catharine during her life time and after her death to pay over the said
share of Money and interest that may have accumulated or accrued thereunto
to all the children of my said daughter Catherine to be divided amongst them
shares alike; and any receipts that my said daughter shall give to my said son
Samuel Hahn or other person or persons in whose trust the said share of Money may
be, Witnessing the payment to her of the interest and profits of the said share of
Money shall be good and sufficient discharges to bar the claims and demands
of all persons whatsoever. Having as security for Daniel Cover the husband
to my daughter Susannah, and Joseph Hahn my son been obliged and compel-
led to pay a much greater amount of Money for them than what would be
my said daughter's and sons just and equal portion of my estate I deem it pro-
per here to state that it is in Consequence and Consideration thereof and not
from any want of parental affection or regard towards my said daughter Susannah
and my son Joseph that I have been induced to leave them no farther share or
portion of all my estate in this my last will and testament.
Sixthly in further trust that my said son Samuel Hahn or his heirs by any legal
process whatever either in law or equity recover of and from Daniel Cover hus-
band to my daughter Susannah and my son Joseph or any of them at any time
when they shall become able and solvent to pay, any sum of Money which I
have heretofore paid as security for them or lent or advanced to them of my
own Money, more than, and over & above the amount that would leave my
daughter Susannah wife of the said Daniel Cover, and my son Joseph Hahn
an equal portion with their brothers and sisters of all my estate, and to divide
any money that may be so recovered of and from the said Daniel Cover, and
my son Joseph amongst my children and grandchildren herein before
named as all other Monies arising from my estate are herein before directed
to be divided amongst them.
And lastly I do hereby constitute and appoint
my said son Samuel Hahn executor of this my last will and testament, hereby
revoking and annulling all my former wills or testaments.
In witness whereof I have huereunto subscribed my name and affixed my seal this
fourth day of June Eighteen hundred and thirty eight.
