Will of Nicholas Phillips dated 1671-06-02 and proved 1672-10-03

The last will and Testament of Nicholas Phillips of Waymoth in New England Aged sixty years or their about
having a serie weake body but doe yet retain my understanding and memory in some competent measure first I do
will give and bequeath my soul and body to god that gave it and doe order that my body be decently buried and
my funerall Expenses wholy discharged and all my debts honestly paid and then all the rest of my worly goods I doe
dispose of as followeth I doe give and bequeath unto my Eldest Son Richard Phillips all that persell of Marsh and
Swamp that he doth hire of me and is now in his own possesion which is by Estemation Six Acres more or less
And I doe give all my wearing Apparel unto my three sons that is Richard Joshua and Benjamin Phillips to be
Equally divided between them as the overseers of this my will shall see good and I doe give and bequeath unto
my Second Son Joshuah Phillips Six pound Sterling out of my whole Estate And I doe give and bequeath unto
my third son Benjamin Phillips Six pound Sterling out of my whole Estate And I doe give and bequeath unto
my oldest daughter Alice Shaw ten pound Sterling out of my whole Estate And I doe give and bequeath
all the rest of my Estate boath house land late books mony and whatsoever else it be that is my own unto my Six
younger Children to be Equally divided between them all : That is to say Joshuah Phillips Benjamin Phillips
Alice Shaw Experience King Lanah White and Abigail Phillips and that their may be an Equall division
so that every one of them may have their due proportion of my children that be of Lawfull age and the
orders in the behalfe of them that and under Age an agree among themselves to all their sattisfaction
then that shall stand firm of my will provided it be done within two months after my decease but if the
Children and the overseers shall not agree within the time above Expressed then my will is that the overseers
shall take it into their own hands and make my children such propositions as themselves shall Judg Equall
And if they cannot find out that which is Equall they shall have full power to sell all or as much of my Estate
as they shall see meet that my will may be fulfilled equally to all my six children for my Eldest son shall keep
his portion by himself and my will is that if their be a sale that some of my own children shall have the
offer of it if they can Answear Engagements without wrong to the rest : And if it be sold my will is that the
twenty and two pound which is given to the three above Expressed shall be paid to each of them and the other
halfe in goods . And I doe make my Son Richard Phillips all my whole Executor and do allow him due sattisfaction
for any trouble he shall be att And I doe desire my Loving Brother Henry Phillips and my Loving freinds
Thomas Dyer and Jonas Humphrey to be the overses to see this my will performed and I doe make void all
my former wills and testaments of this nature and unto I have set my hand and seall the Second day of June
in the year one thousand six hundred seventy and one
