the land owned by the Cincinnati, Richmond and Muncie Railroad Company now known as the
Chesapeake and Ohio Railroad Company of Indiana; then north on said line 600 feet to the
place of beginning

I, John Rigsby, of Union Co, Indiana,
being of sound mind and memory, do make
and execute this my last Will and Testament,
hereby revoking any and all former wills
by me heretofore made.
Item First -- It is my will that all my just
debts be paid out of my personal estate
without delay.
Item Second -- I will devise and bequeath to my
beloved wife, Isabella Rigsby and my two sons,
William M Rigsby and Franklin A Rigsby, the
seventy acres off the south side of the South
West quarter of Section 23, Township 11 Range
1 West on which I now reside. Also forty
acres off the south side of the Northeast
quarter of Section 22, Township 11 Range 1
West. All said land is in Center Township,
Union County, Indiana in equal parts, in
common to their own use in fee simple
forever -- also all my personal property.
Item third -- I will to my daughter Mary Avery,
the sum of Fifty Dollars in cash -- in
addition to what I have already given her.
Item fourth -- Should my beloved wife, not be
living at the time of my death, I devise
and bequeath all the property mentioned
in Item second of this will, to my two
sons William M and Franklin A Rigsby,
in equal parts, as tenants in common,
to their own proper use in fee simple forever.
Item fifth -- Should either of my sons die
without issue before this will takes effect,
then all my property, mentioned in
Item Second of this will, I devise to my
remaining son and his mother in fee
simple forever -- but should either of my
sons die leaving a child or children,
then the share that would belong to such
parent if living, shall go to such child or
children of such deceased parent.
Item sixth -- All my property, both real and
personal, as mentioned in Item Second
of this will, shall go in equal parts to
my said residuary legatees -- my beloved
wife and my two sons -- upon the
sole condition that they pay or cause to
be paid all my just debts and the
specific legacy of fifty dollars mentioned
in Item third of this will, to my daughter,
Mary Avery.
In testimony whereof, I have hereunto
subscribed my name, at Liberty, Indiana,
this the 8th day of March 1887.

Codicil
I John Rigsby on this 10th day of August 1895
being of sound and disposing mind and memory
do make and execute this codicil to the fore-
going will.
First, that part of item second in said will
bequeathing to my beloved wife and my two
sons the seventy acres off the south side of
the SW quarter of Sec 23rd, I wish said item to
read as follows, to-wit: To my beloved wife
Isabella Rigsby I will and bequeath the
seventy acres off the south side of the
South West quarter of Section 23, Township 11,
Range 1 West on which I now reside, to have
and to hold the same to-gether with all my
personal property to her only proper use and
benefit for and during the term of her natural
life. At her death I will and bequeath the same
to my three children William M Rigsby Franklin
A Rigsby and Mary Avery to be shared equally
by them share and share alike.
The remainder of said item second I wish to
change to read as follows to-wit:
To my three children viz William M Rigsby
Franklin A Rigsby and Mary Avery I devise
and bequeath forty acres off the south side
of the North West quarter of Section 22 Towhship
11 Range 1 West to have and to hold the same
for their own use in fee simple forever
All of said real estate being in Center
Township Union County Indiana.
