Know all men by these presents that I Mark
Rigsbee of the County of Orange and State of North
Carolina; being of Sound mind and memory
but considering the uncertainty of my earthly
existance do make and declare this my last will
and testament in manner and form following that is to say

That my Executors hereinafter named shall provide
for my body a decent burial suitable to the wishes of
my relations and friends and pay all funeral
expenses together with my Just debts howsoever
and to whomsoever owing out the moneys that may
first come into their hands as a part or parcel of my
Estate

I give and devise to my youngest son Jefferson
Gaston Johnston one good mule [?] or Ewe [?] to be
set apart for and given to him when he shall
have arrived at the age of Eighteen or nineteen
years

I give and devise to my beloved wife Fannie Rigsbee
One Hundred and thirty acres of land more or less
which is all I own; whereon I now live in also
__ing my mansion [?] house ___ all out [?] houses [?]
and other improvements thereunto belonging [?]
also all my personal and perishable property
of every discription including moneys to have
and to hold to her the said Fannie Rigsbee for
and during the Terms [?] of of her natural life

and my will further more is that after the
death of my beloved wife Fannie Rigsbee that
all the effects of every description which may
be on hand at the time which is not Otherwise
given and devised in this my last will and testament
including real and both personal and perishable
property be sold and equally divided between my
children, To wit, Leroy G Rigsbee Martha H Cates
Narcissa Q J Rigsbee and my youngest son Jefferson
Gaston Johnston Rigsbee to have and to hold
to them and their heirs for ever

And lastly I do hereby constitute and appoint my
beloved son Leroy G Rigsbee and my son in law
Levi F Cates my lawful executors to all intents and
purposes to execute this my last will and testament
according to the true intent and meaning of the
same and every part and clause thereof hereby
revoking and declaring utterly void all other
wills and testaments by me heretofore made

In witness whereof I the said Mark Rigsbee do
hereunto set my hand and seal this the 22 day of
December 1874
