He applied for a pension 1819-08-23.
He states that he enlisted 1776-05-xx and served 15 months as a Private under Captain Joseph Burgess and Colonel Smallwood.
He was in the battles of Long Island, White Plains, and Brandywine.
He lived in Elk Ridge, Anne Arundel Co MD at time of enlistment, and in Henry Co KY at time of pension application.
He married Rebecca Ryan in 1774.
His children were: Axey Marshall, Ephraim, Charles, Betsy Ornan or Oman, Noah, Joseph, Rebecca Shadwick, Zacheus, Polly Warfield, Benjamin, and Ann McCann.

Application for Transfer of Pension

State of Indiana
Harrison Co

On this 20th day of September
1825, Before me the subscriber, Notary Public for
the said County of Harrison, personally appeared Benjamin
Penn who on his oath declares that he is the same person
who formally belonged to the Company commanded by
Capt Barger in the Regiment commanded by Colonel
Smallwood in the service of the United States; That
his name was placed on the pension Rolls of the
Indiana Agency from where he has removed,
That he now resides in the State of Kentucky, where
he intends to remain, and wishes his pension to be
there payable in future, That he at present
receives Eight Dollars per month.
Sworn to and subscribed
before me, the day and
year aforesaid.

A biographical sketch of his grandson Benjamin A Penn says that he is descended from William Penn,
founder of Pennsylvania.
Unfortunately, that is wrong. The immigrant of this Penn branch arrived long after William of Pennsylvania.

Apparently he died intestate. On 1827-06-18 Charles Penn, David Waits, and Edmund Bailey filed a bond for administration of his estate.

I think he must be the one in PA. Note that he had several children before 1790, including my Mary. Also, his son Charles was born in Bedford Co PA in 1788, and son Benjamin was born there in 1790.
